The Guarantee

If the Self Operating Brokerage platform is unavailable for more than 10 minutes in total during a calendar month, your next monthly data fee is waived.

The measurement period runs from the first day of the calendar month through the last day of that month. Downtime is cumulative across the month.

What Counts as Downtime

Downtime means the platform is unable to execute or manage positions for enabled systems due to a failure of ABTrades, LLC's own software or infrastructure, as measured by our monitoring systems.

The following do not count as downtime:

Broker outages, restrictions, rejections, or maintenance, including TastyTrade

Exchange halts, closures, or data feed interruptions from third-party providers

Your internet connection, device, credentials, account status, or broker permissions

Scheduled maintenance announced at least 24 hours in advance

How It Works

The waiver is applied automatically to your next billing cycle. If you believe an outage was missed, notify [email protected] within 15 days of the end of the affected month and we will review our monitoring records.

Our records are controlling.

The waiver applies to one monthly data fee per affected month. It has no cash value, is not paid out as cash or credit, and is not available to accounts that are cancelled, suspended, or past due.

Sole Remedy

Waiver of the monthly data fee is your sole and exclusive remedy for downtime of any length or cause. ABTrades, LLC is not liable for trading losses, missed trades, missed opportunities, slippage, unhedged exposure, margin consequences, or any other direct, indirect, incidental, or consequential damages arising from platform unavailability. Total liability for any outage is capped at one monthly data fee.

Automated trading systems can and do fail. You are responsible for monitoring your own brokerage account and retain the ability to close positions directly with your broker at any time.

General

ABTrades, LLC may modify or withdraw this guarantee at any time; the version in effect at the start of a given month governs that month. This guarantee is governed by the laws of the State of Texas and is subject to our Terms of Use, which control in the event of conflict.
